I. CALL TO ORDER: 

Chairman Cox called the meeting to order at 7:00 P.M.

II. ROLL CALL: 

MEMBERS PRESENT: Chairman Carl Cox, Vice Chairman Karen Creighton, Commissioner Ken Senft, Commissioner Martha Bails, Commissioner Bob Gonzales, Commissioner Dan Morris, Commissioner Tony Segarra.

STAFF PRESENT: Deputy City Attorney Ted Mariscal, Senior Planner Scott Phillips, Planner Desmond McGeough, Planner Jim Atkins, Administrative Assistant Jenifer O'Melia.

III. APPROVAL OF MINUTES:
Minutes of the January 16, 2001 regular meeting were approved.

V. NEW BUSINESS:

A-1. Consideration and action on Application - SP00-179
Don Steinhour of Cricket Communications, on behalf of APS, property owner is requesting consideration and action on a Site Plan for a communication antenna facility, located at 16800 N. Dysart Rd.
(APS - Dysart Communication Antenna Facility) (Staff Recommendation - Approval)

Planner McGeough made a presentation for Application SP00-179.

Commissioner Creighton had questions regarding the stealth canister.

SPEAKER: Rulon Anderson of Cricket Communications, 2345 E. University Dr. Suite 2, stated that the stealth canister is used so that the public cannot tell that there is a cellular antenna.

Commissioner Morris wanted to know if the communication wires and lines are inside the pole.

SPEAKER: Rulon Anderson confirmed that the wires are inside the pole.

Chairman Cox opened the hearing to the public. There were no questions or comments from the public. Chairman Cox closed the hearing to the public.

Commissioner Creighton made a motion to approve Application SP00-179, subject to stipulations a - c attached hereto as Exhibit A. Commissioner Bails seconded the motion.

Motion passed. 7 Yeas and 0 Nays.

B-1. Consideration and action on Application - SP00-182
Thomas Hunt of Hunt Architects, Inc., on behalf of Spirit of Grace Lutheran Church, property owner is requesting consideration and action on a Site Plan for a church, to be located at 15820 W. Clearview Blvd. (Spirit of Grace Lutheran Church)

Planner Atkins made a presentation for Application SP00-182.

Commissioner Morris had concerns regarding the cars overhanging the north sidewalk. He also had concerns regarding the light poles being in the walkway on the sidewalks.

SPEAKER: Thomas Hunt, 10225 N. 38th St., stated that the overhang on the sidewalk will be about two feet and the sidewalk is not expected to be busy. He stated that there is no sidewalk infringement by the base of the light poles they are set off of the sidewalk.

Commissioner Morris had concerns regarding the property lines to the north and west. In regards to the fence and the property lines, what is the agreement with Del Webb. 

SPEAKER: Thomas Hunt stated that there is no agreement needed according to Del Webb. The wall is positioned within a few inches of the property line.

Chairman Cox wanted to know why there was not a sidewalk east of this project.

SPEAKER: Thomas Hunt stated that Del Webb did not want foot traffic along this side of the street. There is foot traffic on the other side of the street.

Commissioner Segarra had a concern regarding the height of the building meeting the height restrictions at 24 feet.

SPEAKER: Thomas Hunt stated that the building's height is about 22 or 23 feet with the exception of the spire.

Chairman Cox opened the hearing to the public. There were no questions or comments from the public. Chairman Cox closed the hearing to the public.

SPEAKER: Thomas Hunt stated his concern in regards to the landscaping stipulation. He stated that Del Webb and the City of Surprise have different wants and needs regarding landscaping.

Planner Atkins stated that in regards to the landscaping review it is standard procedure for the Community Development Director and the department to review and check the submitted plans with the planned area developments to ensure the development standards have been met as well as the city ordinance. They look at the intent, the overall site and take everything into consideration.

Commissioner Senft made a motion to approve Application SP00-182, subject to stipulations a - I attached hereto as Exhibit B. Commissioner Bails seconded the motion.

Motion passed. 7 Yeas and 0 Nays.

C-1. Public Hearing - Application PP00-138
David Gulino of Land Development Services, L.L.C., on behalf of Meeker Ltd., Partnership, property owner is requesting consideration and action on a Preliminary Plat for a commercial subdivision, located at the northeast corner of Brookside and Bell Road. (Brookside Center)

Planner McGeough made a joint presentation for Application PP00-138 and Application FP00-139. 

Commissioner Segarra had a concern in regards to the road leading to the Mondel House, as well as the preschool traffic. He raised a question about a potential need for traffic calming in that area in the near future.

Chairman Cox wanted clarification on the site plan.

SPEAKER: David Gulino of Land Development Services, 4413 N Saddleback Trail, stated on the plat there is an access easement and an agreement with a property owner to the east to use their access.

Commissioner Gonzales had a concern that the approval of the project will generate more traffic by having a road go through from Bell Road to Mondell Road.

SPEAKER: David Gulino stated that traffic will be right in and right out only onto Bell Road.

Chairman Cox and Commissioner Creighton had a concern with traffic cutting through the site and would like a stipulation stating that the access to Mondell Road be eliminated for safety reasons.

SPEAKER: Thomas Van Arsdale, property owner stated that he had no objections to the stipulation to eliminate access to Mondell Road.

Chairman Cox opened the hearing to the public. There were no questions or comments from the public. Chairman Cox closed the hearing to the public.

C-2. Consideration and action on Application PP00-138
David Gulino of Land Development Services, L.L.C., on behalf of Meeker I Ltd., Partnership, property owner is requesting consideration and action on a Preliminary Plat for a commercial subdivision. (Staff Recommendation - Approval)

Commissioner Bails made a motion to approve Application PP00-138, subject to stipulations a - h attached hereto as Exhibit C. Commissioner Segarra seconded the motion.

Motion passed. 7 Yeas and 0 Nays.

D-1. Public Hearing - Application FP00-139
David Gulino of Land Development Services, L.L.C., on behalf of Meeker I Ltd., Partnership, property owner is requesting consideration and action on a Final Plat for a commercial subdivision, located at the northeast corner of Brookside and Bell Road. (Brookside Center)

Chairman Cox opened the hearing to the public. There were no questions or comments from the public. Chairman Cox closed the hearing to the public.

D-2. Consideration and action on Application FP00-139
David Gulino of Land Development Services, L.L.C., on behalf of Meeker I Ltd., Partnership, property owner is requesting consideration and action on a Final Plat for a commercial subdivision. (Staff Recommendation - Approval)

Commissioner Morris made a motion to approve Application FP00-139, subject to stipulations a - h attached hereto as Exhibit D. Commissioner Bails seconded the motion.

Motion passed. 7 Yeas and 0 Nays.

Commissioner Morris stated he's seen several sandwich boards propped up around the city.

Chairman Cox would like to know what the city can do to propose to Home Depot to come back to the city and apply for a separate storage building. He also wanted to know how many times they have been fined by the city.

Planner Phillips stated that the city has approached Home Depot to apply for the storage buildings. He stated that Home Depot has not been fined.

Commissioner Morris stated that once they have been warned if the city can fine them for each item.

Commissioner Bails stated they should make a recommendation for the city council to put this problem on their agenda.

Commissioner Gonzales wanted to know the status on the lot split south of Walgreen's, south of Grand. He wanted an explanation from staff between this commercial lot split and R1-43.
He also wanted to know how much time can lapse.

Planner Phillips stated that there were no concessions made with this property; it was not a lot split. There have been issues that have held the progress up on this site.

IX. ADJOURNMENT: 

There was no further business. On a motion duly made and seconded. Chairman Cox declared the meeting adjourned at 8:10.
