REGULAR MEETING

 

May 21, 2002

6:00 P.M.

 

 

Call to Order:

           Roll call:

 

Chairman Bails called the Regular Planning and Zoning Commission Meeting to order at 6:00 p.m., at the Surprise City Hall – 12425 West Bell Road, Suite D-100, Surprise, Arizona 85374, on Tuesday, May 21, 2002.  Also in attendance with Chairman Bails were Vice Chairman Dan Morris, Commissioners Ken Senft, Tony Segarra, Bob Gonzalez, Lyn Truitt, and Jan Blair.  

 

Staff Present:

 

Deputy City Attorney, Jeff Blilie; Planning Manager, Scott Phillips; Assistant Planning Manager, Grant Penland; Planning Associate, Stephanie Wilson; Administrative Assistant, Jenifer O’Melia.

 

·        Approval of Planning and Zoning Meeting Minutes - APPROVED

 

Truitt made the motion to approve the Regular Planning and Zoning Minutes of May 7, 2002.  Morris seconded the motion. 7 yes votes.  Motion carried.

·        Discussion and possible direction regarding the standard stipulations on sound attenuation and overflight noise..

 

General discussion took place with the Commission.  They requested a joint meeting with City Council, Commission and staff from the city and Luke Air Force Base.

 

There were no comments from the public.

 

Commissioner Segarra made a motion that every project coming forward must have the four Luke Air Force Base preservation stipulations that are within the designated area within the vicinity of the base.  Bails seconded the motion.  7 yes votes.  Motion carried.

 

 

·        Discussion regarding what is left to develop around the noise contour lines.

 

There were no comments made by the commissioners.

 

·        Consideration and action to recommend approval of Application RS02-071, Rural Subdivision for Breckner’s Place.

 

Planner, Penland made a presentation for Application RS02-071.

 

No commission questions or public comments were made.

 

Truitt made a motion to recommend approval for Application RS02-071, subject to stipulations a – l attached hereto as Exhibit A.  Gonzales seconded the motion.  7 yes votes.  Motion carried.

 

·        Consideration and action to recommend approval of Application CUP02-088, Conditional Use Permit for McEwen Garage.

 

Associate Planner, Wilson made a presentation for Application CUP02-088.

 

General discussion took place with the Commission.  They stated they would like the applicant to have landscape buffering around the garage.

 

Morris made a motion to recommend approval for Application CUP02-088, subject to stipulations a – l attached hereto as Exhibit B.  Truitt seconded the motion.  7 yes votes.  Motion carried.

 

·        Consideration and action to recommend approval of Application CUPA02-100, Conditional Use Permit Amendment for Learning Matters Charter School.

 

Planner, Penland made a presentation for Application CUPS02-100.

 

General discussion took place with Commission.  They stated their concerns with keeping the children out of the construction area.

 

Morris made a motion to recommend approval for Application CUPA02-100, subject to stipulations a – o attached hereto as Exhibit C.  Segarra seconded the motion.  7 yes votes.  Motion carried.

 

REGULAR ITEMS REQUIRING A PUBLIC HEARING:

 

·        Consideration and action to recommend approval of Application PP02-094, Preliminary Plat for Coronado @ Sun City Grand.

 

Associate Planner, Wilson made a presentation for Application PP02-094.

 

No commission questions or public comments were made.

 

Senft made a motion to recommend approval for Application PP02-094, subject to stipulations a – k attached hereto as Exhibit D.  Blair seconded the motion.  7 yes votes.  Motion carried.

 

·        Consideration and action to recommend approval of Application FP02-095, Final Plat for Esperanza @ Sun City Grand.

 

Associate Planner, Wilson made a presentation for Application FP02-095.

 

No commission questions or public comments were made.

 

Truitt made a motion to recommend approval for Application FP02-095, subject to stipulations a – h attached hereto as Exhibit E.  Senft seconded the motion.  7 yes votes.  Motion carried.

 

·        Consideration and action to recommend approval of Application FPA02-083, Final Plat Amendment for Coyote Lakes Unit 2 Tract B.

 

Planner, Penland made a presentation for Application FAP02-083.

 

General discussion took place with Commission.  They stated their concerns with legal easements and access’s to and from each property.

 

Bails opened the hearing to the public.

 

SPEAKER:  Richard Snyder, 11557 Badger Ct., stated  he is a resident of Coyote Lakes and is in favor of the project.

 

SPEAKER: James Cain, 11548 Bighorn Ct., stated that the access has always been shared and that there is an agreement in place.

 

Bails closed the hearing to the public.

 

Truitt made a motion to recommend approval for Application FPA02-083, subject to stipulations a – c attached hereto as Exhibit F.  Morris seconded the motion.  7 yes votes.  Motion carried.

 

·        Consideration and action to recommend approval of Application FP02-081, Final Plat for Cotton Gin.

 

Planner, Penland made a presentation for Application FP02-081.

 

No commission questions or public comments were made.

 

Morris made a motion to recommend approval for Application FP02-081, subject to stipulations a – t attached hereto as Exhibit G.  Segarra seconded the motion.  7 yes votes.  Motion carried.

 

·        Consideration and action to recommend approval of Application FP02-075, Final Plat for Mountain Gate Phase 1 & 2.

 

Planner, Penland made a presentation for Application FP02-074 and Application PAD02-028 together.

 

General discussion took place with Commission.

 

No public comments were made.

 

Segarra made a motion to recommend approval for Application FP02-075, subject to stipulations a – o attached hereto as Exhibit H.  Morris seconded the motion.  7 yes votes.  Motion carried.

 

·        Consideration and action to recommend approval of Application PAD02-028, Planned Area Development for Mountain Gate.

 

General discussion took place with Commission.  Commission stated they would like narrower streets, a possible hill in the park.  They stated their concern with the property location to Luke Air Force Base.

 

Morris made a motion to recommend approval for Application PAD02-028, subject to stipulations a – p attached hereto as Exhibit I.  Gonzalez seconded the motion.  3 yes votes, 4 no votes.  Motion denied.
