I. CALL TO ORDER

Vice Chairman Creighton called the meeting to order at 7:00 P.M.

II. ROLL CALL: 

MEMBERS PRESENT: Vice Chairman Karen Creighton, Commissioner Martha Bails, Commissioner Antonio Segarra, Commissioner Ken Senft, Councilman Roy Villanueva

III. APPROVAL OF MINUTES:

Minutes of the November 7, 2000 regular meeting were approved with one correction noted.

IV. WITHDRAWALS AND CONTINUANCES:

A-1. Application GPA00-156
Stephen C. Earl of Earl, Curley and Lagarde on behalf of Del Webb Home Construction, Inc., property owner is requesting consideration and action on a General Plan Amendment for the development known as Sun City Grand. The site is approximately 48 gross acres bounded by Union Hills Dr. alignment on the south, Loop 303 on the east, Beardsley Canal/McMicken Dam on the west and north.

Stephen C. D-1. Application PAD00-35
Core Group Consultants LTD., on behalf of Summer Winds L.L.C., property owner is requesting consideration and action on rezoning certain parcels of property to Planned Area Development for a subdivision to be known as Rio Rancho Estates on approximately 184 gross acres, located primarily on the north side of Happy Valley Road and southwest of Grand Ave., with a small parcel located south of Happy Valley Road.

V. NEW BUSINESS:

A-1. Public Hearing - Application CUP00-147
Don and Karen Decker, the property owner is requesting 
consideration and action on a Conditional Use Permit for an
accessory building upon a single-family residential lot located at 
16132 W. Peakview Road.

Planner McGeough made a presentation for Application CUP00-147.

Commissioner Segarra stated that if possible the commission would like the vicinity map ahead of time so the commission members may go out to the site before meetings.

Vice Chairman Creighton stated concerns with the bathroom facility in the garage being used as residential use.

SPEAKER: Donald Decker, 5113 W. Crocus Dr., the applicant stated that the bathroom facility is strictly used to clean up before entering his home.

Vice Chairman Creighton opened the hearing to the public. 

SPEAKER: Ruth Harrigan 16043 W. Peakview Rd., stated her concern regarding the amount of square footage and the height of the building due to CC&R guidelines.

Planner McGeough stated the single-family dwelling and the garage combined are 5% of the acreage and stated the building height will be twelve feet high.

Vice Chairman Creighton closed the hearing to the public.
Commissioner Senft had a concern if the applicant has looked at the CC&R to make sure the applicant is in compliance and has approval form the CC&R. 

SPEAKER: Donald Decker stated that he has reviewed the CC&R and needs to still submit plans for the approval of the CC&R.

Vice Chairman Creighton re-opened the hearing to the public.

SPEAKER: James Juber, of 161st Ave. and Peakview Rd. had concerns with the positioning of the building regarding the boundary lines.

Planner McGeough showed Mr. Juber the exhibits.

SPEAKER: Yalanda Payne, 16013 W. Peakview Rd., stated her concern regarding how the structure was going to be used, and that it is only used as residential use and not a business use.

Vice Chairman Creighton closed the hearing to the public.

A-2. Consideration and action on Application CUP00-147
Don and Karen Decker, the property owner is requesting consideration and action on a Conditional Use Permit for an accessory building.
(Staff Recommendation - Approval)

Commissioner Segarra made a motion to approve Application CUP00-147, subject to stipulations a - e attached hereto as Exhibit A. Commissioner Senft seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent.

B-1. - Public Hearing - Application FP00-125
Tim Keenan of Surprise Village Company L.L.C., property owner, is 
requesting consideration and action on a Final Plat for a subdivision to be known as Surprise Farms, consisting of 190 single family residential lots on 33.97 gross acres, located south of Bell Road, north of Greenway Road, West of Cotton Lane and east of 175th Avenue.
(Surprise Farms Phase 1B - Parcel 9) 

Planner Atkins made a presentation for Applications FP00-125 through Application FP00-132. He stated that this project has an extensive trail system and a school site.

SPEAKER: Tim Keenan of Surprise Village Co., L.L.C., on behalf of the applicant made a presentation for the project. He stated that on the site there are two church sites, three school sites in the future, acreage for a fire station and fourteen percent open space.

SPEAKER: Tom Murphy of Dysart School District stated that there will be a K-8 school built in 2004, a second K-8 school for either 2005 or 2006, and a high school site requested for 2003.

Vice Chairman Creighton wanted to know if the applicant already has an agreement with Dysart School District.

SPEAKER: Tom Murphy stated that they are still in negotiation.

SPEAKER: Tim Keenan stated that there is also going to be a Catholic Church and school on the site.

Commissioner Senft had concerns with the roadways with the center islands.

SPEAKER: Tim Keenan stated within the center of the roadways there is a trail system that is depressed. Additionally, the trail system is only on the main collectors.

Vice Chairman Creighton had a question pertaining to all the applications, in the staff report under the historical information that an additional amendment has been filed with the city but has not been approved regarding side setbacks.

Planner Atkins stated it was carried over from the preliminary plat application.

Planner Phillips stated that the applicant has withdrawn the amendment and the applicant is using the design standards.

Vice Chairman Creighton had a concern regarding the staff stipulation regarding noise levels. She would like a stipulation added that the over flight of Luke Air Force Base be included in the public report.

Vice Chairman Creighton had a concern regarding the project narrative under 5.2, regarding to Parcel nine, it states there may playgrounds and other amenities, and she would like to change it to there will be playgrounds and other amenities.

SPEAKER: Tim Keenan stated that he would like to have it left up to the developers. He stated that it depends on the demographic of each builder and that the builder still needs to get approval for the recreation land. He also stated that there are large park areas throughout the project.

Commissioner Senft stated that the narrative should read as, "They will have amenities appropriate to the community."

Commissioner Segarra had a concern regarding stipulation b and the Street Light Improvement District. He wanted to know why there is a stipulation specifying S.L.I.D. or Homeowners Association.

SPEAKER: Tim Keenan stated that the stipulation is there in case the courtyard becomes a private community.

Deputy City Attorney Ted Mariscal stated that in regards to stipulation n, he suggests adding subject to review by the Community Development Director.

Commissioner Bails made a motion to approve Application FP00-132, subject to stipulations a - m attached hereto as Exhibit I.

J-1. Public Hearing - Application CUP00-145
Robert Winton of Winton Architects, Inc., on behalf of Christine Jones, property owner is requesting consideration and action on a Conditional Use Permit for a daycare located north of Bell Road and east of Reems Road near the intersection of Mondell Road and Brookside.

Planner Penland made a presentation for Application CUP00-145. 

Commissioner Creighton wanted to know if the applicant was present.

Planner Penland stated that the applicant was not in attendance.

Commissioner Segarra had concerns with the parking lot and the circulation of traffic. He also stated that he would like to continue this application to the next meeting so that the commissioners can ask the applicant questions.

Vice Chairman Creighton had concerns with the fencing around the property regarding the safety of the children.

J-2. Consideration and action on Application CUP00-145
Robert Winton of Winton Architects, Inc., on behalf of Christine Jones, property owner is requesting consideration and action on a Conditional Use Permit for a daycare.

Commissioner Bails made a motion to continue Application CUP00-145 to the December 5, 2000 regular meeting. Commissioner Senft seconded the motion.

K-1. Public Hearing - Application CUP00-140
Roger Waite of New Song United Methodist Church, property owner is requesting consideration and action on a Conditional Use Permit for New Song United Methodist Church. The site is generally located on the southwest corner of Bell Road and Sarival Road.

Planner Atkins made a presentation for Application CUP00-145.

Vice Chairman Creighton asked if the applicant was present.

SPEAKER: Ken Allison of Vision Planning associates stated that he is the architect on the project.

Commissioner Segarra had concerns regarding the parking lot and stated he would like angled parking.

SPEAKER: Ken Allison stated that they will look into angled parking for phase two.

Vice Chairman Creighton had a concern regarding the amount of ADA parking. The staff report stated that ten spaces was minimum but the plan only shows six.

SPEAKER: Ken Allison stated that they need ten total ADA spaces on the entire project and that six ADA spaces for phase one meets the requirements.

Vice Chairman Creighton opened the hearing to the public.

SPEAKER: Joan Sisco, 9414 N. 25th Pl., on behalf of Bell - Sarival Investors stated that she represents the owners across the street on the south-east corner and that the property owners are not opposed to the church. The property owners concern was that they would not be able to sale or serve liquor and she wanted to know the actual footage of how far they need to be from the church to sale liquor.

Planner Atkins stated that the staff is not certain of the state statute for distance from door or property line from a church to a liquor establishment.

Planner Phillips stated that the commission should not hold up the church since they are ready to continue and the adjacent owners have not submitted an application for any project on their site.
He also stated that when the adjacent owner is ready to submit an application the staff is willing to work with the adjacent owners.

K-2. Consideration and action on Application CUP00-140
Roger Waite of New Song United Methodist Church, property owner is requesting consideration and action for a Conditional Use Permit for a church.
(Staff Recommendation - Approval)

Commissioner Bails made a motion to approve Application CUP00-140, subject to stipulations a - k and is attached hereto as Exhibit J. Commissioner Segarra seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent.

VI. COMMENTS FROM THE FLOOR ON NON-AGENDA ITEMS:

VII. REPORT FROM PLANNING AND ZONING DEPARTMENT:

Interim Director of Community Development John Guenther stated that there is a notice regarding an education training presentation for the proposed general plan for November 30, 2000 during the day.

VIII. REPORT FROM PLANNING AND ZONING COMMISSION:

Vice Chairman Creighton wanted to know if the over view of the Green Building seminar was ready to be handed out.

Commissioner Bails wanted to know if the staff could add to the staff report, under the case number the stipulations.

Planner Phillips stated that indeed the staff will add the stipulations to the cover of the staff report.

Commissioner Segarra had concerns with Home Depot and their parking lot having several tables set up which is taking away from parking especially when the full development is built out.

Planner Atkins stated that they will be selling Christmas trees, which is taking up the space.

Vice Chairman Creighton wanted to know if Wal-Mart has received their C of O.

Interim Director of Community Development John Guenther stated that it should have been handled and that everything has been addressed.

Commissioner Segarra had concerns with the Jack In The Box parking lot with all the construction going on.

Planner Phillips stated that he will check into the requirements on the site plan and the parking lot they have now is part of a future development.

IX. ADJOURNMENT: 8:50

There was no further business. On a motion duly made and seconded. Vice Chairman declared the meeting adjourned at 8:50.
