I. CALL TO ORDER:

Chairman Bails called the meeting to order at 7:00 p.m.

II. ROLL CALL:

MEMBERS PRESENT: Chairman Martha Bails, Commissioner Bob Gonzales, Commissioner Tony Segarra, Commissioner Lyn Truitt.

STAFF PRESENT: Deputy City Attorney Ted Mariscal, Community Development Director Phil Testa, Planning Manager Scott Phillips, Planner Desmond McGeough, Planner Grant Penlnad, Administrative Assistant Jenifer O’Melia, Intern Susan Kefer.

III. APPROVAL OF MINUTES: approved

Minutes of the August 21, 2001 regular meeting were approved.

V. NEW BUSINESS:

A-1. Public Hearing - Application CUP01-61

Bruce Daniels on behalf of Northwest ranch, L.L.C., property owner is requesting consideration and action on a Conditional Use Permit for a master sign program located on the northeast corner of Greenway Road and Sarival Road.

Planner Penland made a presentation for Application CUP01-61.

Commissioner Segarra wanted to know what a PDP submittal is? He also wanted to know what will happen to the signs after the development if built out. He feels is it not correct to have the Homeowners Association pay for the signs after the development is built out.

Planner Penland replied that a PDP is Proposed Development Plan. He stated that he believes the signs will stay and that they are permanent and would be utilized for the trail system.

Chairman Bails opened the hearing to the public.

SPEAKER: Dave Ostlund, 15768 N. 162nd Lane, stated he is a resident of Northwest Ranch and how are the residents notified of this.

Deputy City Attorney replied that there is no notification for a Conditional Use Permit.

Chairman Bails closed the hearing to the public.

A-2. Consideration and action on Application CUP01-61

Bruce Daniels on behalf of Northwest ranch, L.L.C., property owner is requesting consideration and action on a Conditional Use Permit for a master sign program.

(Staff Recommendation - Approval)

Commissioner Gonzales made a motion to continue this application to the September 18, 2001 regular meeting because the applicant is not in attendance. Commissioner Segarra seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent.

B-1. Public Hearing - Application PP01-67

Richard Schwartz of Stanley Consultants Inc., on behalf of Del Webb Home Construction Inc., property owner is requesting consideration and action on a Preliminary Plat for a residential subdivision, located south of Clearview Boulevard in Sun City Grand.

Chairman Bails wanted to know how someone would get to the site today.

Planning manager Phillips stated that Cotton Lane is the point of access and this facility will require two points of access, there is a temporary access point off the Loop 303.

Chairman Bails opened the hearing to the public. There were no questions or comments from the public. Chairman Bails closed the hearing to the public.

B-2. Consideration and action on Application PP01-67

Richard Schwartz of Stanley Consultants Inc., on behalf of Del Webb Home Construction Inc., property owner is requesting consideration and action on a Preliminary Plat for a residential subdivision.

(Staff Recommendation - Approval)

Commissioner Segarra made a motion to approve Application PP01-67, subject to stipulations a - h attached hereto as Exhibit A. Commissioner Truitt seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent

Chairman Bails stated for the record that she is a resident of Sun City Grand and there is no conflict on interest on this application.

C-1. Consideration and action on Application SP01-48

Kent Dounay of P/D Architects, on behalf of Kitchell Development, property owner is requesting consideration and action on a Site Plan for a restaurant, located approximately 650 feet south of the southeast corner of Parkview Place and Grand Avenue.

Planner Penland let the commission know the applicant was unable to attend the meeting.

Commissioner Gonzales made a motion to continue this application to the September 18, 2001 regular meeting. Commissioner Segarra seconded the motion.

D-1. Public Hearing - Application FP01-62

Daniel Pottinger of RBF Consultants on behalf of Beazer Homes for Mission Park Associates, property owner is requesting consideration and action on a Final Plat for a residential subdivision, located at the northeast corner of Waddell Road and Bullard Avenue.

(Ashton Ranch Unit IV)

Planner McGeough made a presentation for Application FP01-62.

Commissioner Segarra stated that on page three of the narrative where it says m, it should be tract n.

Chairman Bails opened the hearing to the public. There were no questions or comments from the public. Chairman Bails closed the hearing to the public.

D-2. Consideration and action on Application FP01-62

Daniel Pottinger of RBF Consultants on behalf of Beazer Homes for Mission Park Associates, property owner is requesting consideration and action on a Final Plat for a residential subdivision.(Staff Recommendation - Approval)

Commissioner Segarra made a motion to approve Application FP01-62, subject to stipulations a - j attached hereto as Exhibit B.

Commissioner Gonzales seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent.

E-1. Consideration and action on Application SP01-57

Jon Mantens of Mantens & Associates Architects, on behalf of Pioneer Landscape Materials Inc., property owner is requesting consideration and action on a Site Plan for a sales and office building, located at 13460 W. Westgate Drive.

Planner Penland made a presentation for Application SP01-57.

Commissioner Truitt had concerns with a safety issues and if a study was going to be done with the new amount of turns onto Bell Road.

Planner Penland replied that he believes there is a traffic light being planned to be installed at the intersection in question.

Commissioner Gonzales had concerns with the building being simple and boring. He would like to maybe see more pop outs and windows on the building.

Planner Penland replied that the only pop out on the building is in the front of the building, but that is the only part of the building visible to the public.

Commissioner Gonzales had concerns with the rear yard not being improved and being used.

Planner Penland stated that the intent of the rear yard is to only for storage area and that the only flow of traffic going through the back gates would be for emergency vehicles.

Commissioner Gonzales made a motion to continue this application to the September 18, 2001 regular meeting. Commissioner Segarra seconded the motion.

F-1. Public Hearing - Application RS01-75

Max Witter, property owner is requesting consideration and action

for a rural residential subdivision to be known as Max’s Corner, located at the southwest corner of 163rd Avenue and Dixeleta.

Planner McGeough made a presentation for Application RS01-75.

Commissioner Gonzales had concerns regarding the water easement and if the property owners will be able to fence in their entire property.

SPEAKER: Max Witter, replied that there is a water easement and that he has a “will serve” letter from Maricopa Water District. He also stated that property owners will be able to fence in their property. He stated he will put a water easement on the final plat.

F-2. Consideration and action on Application RS01-75

Max Witter, property owner is requesting consideration and action

for a rural residential subdivision to be known as Max’s Corner.(Staff Recommendation - Approval)

Commissioner Gonzales made a motion to approve Application RS01-75, subject to stipulations a - j attached hereto as Exhibit C. Commissioner Segarra seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent

G-1. - Public Hearing - Application - PAD01-49

Joe Walsh of Coe & Van Loo Consultants, Inc. on behalf of M&B Capital Group L.L.C., property owner is requesting consideration and action on rezoning certain parcels of property to Planned Area Development for a residential subdivision to be known as Cotton Gin, consisting of approximately 80 acres, located at the northeast corner of Reems Road and Waddell Road.

Planner Penland made a presentation for Application PAD01-49.

Chairman Bails had concerns regarding the open space and where are the residents going to park to get to the open spaces.

Planner Penland stated that throughout the development there is curb-separated sidewalks and this provides a pedestrian walking trail to the open spaces.

Commissioner Truitt had concerns with the setbacks being able to encroach up to ten feet into the rear yard, leaving only five feet between the patio cover and the rear property line.

Planning Manager Phillips replied the intent is to follow the ordinance, which requires a minimum of 10 feet to the property line. He also stated that he would check into the language and revise it in the upcoming UDC as necessary.

G-2. Consideration and action on Application PAD01-49

Joe Walsh of Coe & Van Loo Consultants, Inc. on behalf of M&B Capital Group L.L.C., property owner is requesting consideration and action on rezoning certain parcels of property to Planned Area Development for a residential subdivision to be known as Cotton Gin.

(Staff Recommendation - Approval)

Commissioner Segarra made a motion to approve Application PAD01-49, subject to stipulations a - I attached hereto as Exhibit D. Commissioner Truitt seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent

H-1. Consideration and action on a policy to require landscape medians in all arterial roadways.

Intern Kefer made a presentation to the commissioners in regards to landscape medians in arterial roadways.

Chairman Bails wanted to know if the city has done a cost analysis for this project. She also had concerns when the developer or landowners do not have the funds to put in the medians.

Planning Manager Phillips replied that with medians there is constant but small maintenance and other cities show that landscape medians can reduce cost. He explained that what is being presented is only draft policies and there is a lot of work still to do.

Commissioner Segarra wanted to know how it provides safety for the residents.

Intern Kefer replied that the medians give pedestrians a refuge from traffic and a point of safety in the middle of the road.

Commissioner Segarra made a motion to approve the landscape median policy. Commissioner Truitt seconded the motion.

Motion passed. 4 Yeas, 0 Nays, and 3 Absent

VI. COMMENTS FROM THE FLOOR ON NON-AGENDA ITEMS:

There were no questions or comments from the floor.

VII. REPORT FROM PLANNING AND ZONING DEPARTMENT:

Community Development Director Testa wanted to remind the commission of the special meetings on September 11, 2001 at Kingswood Park and the September 13, 2001 council workshop.

VIII. REPORT FROM PLANNING AND ZONING COMMISSION:

Commissioner Segarra had concerns within Commerce Park in regards to signage.

Planning Manager Phillips stated that staff has approached business owners and made requests to have a master sign program but the owners do not want the program.

Chairman Bails stated that the Del Webb meeting has been moved to October 16, 2001.

IX. ADJOURNMENT:

There was no further business. On a motion duly made and seconded. Chairman Bails declared the meeting adjourned at 9:00 P.M.
