I. CALL TO ORDER:

Vice Chairman Bails called the meeting to order at 7:03 P.M.

II. ROLL CALL:

MEMBERS PRESENT: Vice Chairman Martha Bails, Commissioner Bob Gonzales, Commissioner Ken Senft, Commissioner Dan Morris

STAFF PRESENT: Deputy City Attorney Ted Mariscal, Community Development Director Phil Testa, Planning Manager Scott Phillips, Assistant Planning Manager Anthony Chinyere, Planner James Atkins, Planner Desmond McGeough, Planner Grant Penland, Administrative Assistant Jenifer O’Melia

III. APPROVAL OF MINUTES:

Minutes of the June 19, 2001 regular meeting were approved.

IV. WITHDRAWALS AND CONTINUANCES:

Community Development Director Phil Testa stated that staff is requesting that the Sierra Montana hearing and action be continued to the August 7, 2001 meeting. The reason for the request is to give staff the opportunity to resolve some issues.

Vice Chairman Bails wanted to know if the commission could still hold the public hearing and continue the applications.

Deputy City Attorney Ted Mariscal replied that it is the chairs discretion to open the hearing to the public.

Vice Chairman Bails stated that the public will speak.

Community Development Director Phil Testa stated that there will be no action taken on the applications.

Commissioner Morris stated his concerns in regards to staff having enough time to solve the issues and there is an inconvenience to the public by continuing the applications.

Community Development Director Phil Testa stated that staff and the applicant are committed to bringing this forward by the August 7, 2001 meeting.

V. NEW BUSINESS:

A-1. Consideration and Action on the selection of a new Chairman and Vice Chairman

Vice Chairman Bails asked the commissioners if they would like to wait until there is a full commission before voting.

Commissioner Morris stated he thinks it is best to have a full commission for the voting.

Commissioner Senft agreed with waiting for a full commission.

Vice Chairman Bails stated that this item will be placed on the August 7, 2001 agenda.

B-1. Consideration and Direction - General Plan implementation status

The City of Surprise Planning and Zoning Department is requesting consideration and direction on the updated General Plan implementation schedule and priorities.

Assistant Planning Manager Chinyere made a presentation on the status of the General Plan implementation.

Vice Chairman Bails had concerns about the timing of the projects and she felt the responsibilities should be consolidated. She also wanted all school districts listed that are applicable, not just Dysart School District that is in the city. She also would like staff to take a look at eliminating all lots less than fifty feet and create a bedroom/garage ratio.

Commissioner Morris stated his concern with the large number of ongoing projects and staff is only taking action on three.

Assistant Planning Manager Chinyere stated other departments are working a number of the ongoing projects.

Commissioner Senft wanted to know if the city has a plan for a large-scale emergency, being able to evacuate the residents.

Assistant Planning Manager Chinyere stated there are ongoing discussions led by the Fire Department.

C-1. Public Hearing - Initiate Major Plan Amendment to integrate State Land Department conceptual plan with the City of Surprise General Plan

The City of Surprise Planning and Zoning Department is requesting consideration and action on initiating a major plan amendment to integrate the State Land Conceptual Plan for the Surprise Study Area into the General Plan 2020 land use map. The subject area is located east of 211th Avenue, north of Yorkshire Drive, west of Perryvile Road, and south of Jomax.

Assistant Planning Manager Chinyere made a presentation in regards to initiate major Plan Amendment to integrate State Land Department conceptual plan with the General Plan.

Commissioner Gonzales had concerns with what will happen to private land and if most of the land we are annexing is state lands.

Assistant Planning Manager Chinyere replied that most of the land will be state land plus some private parcels.

Vice Chairman Bails had concerns with what happens if the private landowners do not want to be annexed.

Vice Chairman Bails opened the hearing to the public.

SPEAKER: Lise Rodgers 16079 W. Desert Lane, stated her concerns in regards to integrating more land, when the city has developed guidelines for these open spaces. She also started that by allowing the integration of the land she believes it opens the door to developers, and then the lands around the White Tank Mountains.

SPEAKER: Ray Prendergast 10914 Palmeris Dr., stated his concerns about the word integrate, he feels it should be changed to reference. He has concerns about the state land people dictating to the city.

Assistant Planning Manager Chinyere stated that the city is required to work with the state land in the conceptual planning process.

SPEAKER: Bill Lipscomb 14976 W. Bottletree, stated his concerns are the integrating and solidifying the rural guidelines.

Vice Chairman Bails closed the hearing to the public.

C-2. Consideration and Action - Initiate Major Plan Amendment to integrate State Land and conceptual plan with the General Plan

The City of Surprise Planning and Zoning Department is requesting consideration and action on initiating a major plan amendment to integrate the State Land Conceptual Plan for the Surprise Study Area into the General Plan 2020 land use map.

Commissioner Morris stated that integrate is a leading word and would like it changed to reference and reconcile.

Commissioner Morris made a motion to approve this action. Commissioner Gonzales seconded the motion.

Motion passed.

D-1. Public Hearing - Rural Development Standards and Design Guidelines status

The City of Surprise Planning and Zoning Department is requesting consideration and action on adopting the Rural Development Standards and Design Guidelines as an element of the General Plan 2020.

Assistant Planning Manager Chinyere made a presentation on the Rural Development Standards and Design Guidelines status.

Vice Chairman Bails was concerned with property owners not wanting their land use changed.

Assistant Planning Manager Chinyere stated there have been several meeting with property owners and no one objected to the rural designation.

SPEAKER: Richard Counts 3900 E. Camelback, consultant for the City of Surprise, summarized the development standards.

Commissioner Senft wanted to know if the character area was removed from the southern area of Sun Valley Parkway what would the land be designated as. He also wanted to know why staff wants character area designated north of Sun Valley Parkway and why not leave the land designation rural.

Assistant Planning Manager Chinyere stated the land south of the Parkway is designated as rural. He replied with the character area it is easier to develop around growth areas and make them viable.

Commissioner Morris stated that the legend on the map should be changed to say Character/Rural area and Agricultural/Animal properties.

Vice Chairman Bails opened the hearing to the public.

SPEAKER: Carolyn Robles, 14041 N. 184th Ave., stated that the city made a promise to the citizens to designate more rural land and they did not live up to the promise. She stated her concerns about Mr. Counts involvement with the Arizona State Land Department. She stated her recommendations to create more rural areas as promised within the city, define rural character as 0 –1 homes per acre, remove the character area on the south side of the Parkway, and for Mr. Counts not to plan any state trust land in the City of Surprise.

SPEAKER: Lise Rodgers, 16079 W. Desert Lane, stated her thank you to Philip Testa and Tony Chinyere for meeting with her. She would like the character area removed from south of the Sun Valley Parkway and show it on the map for the City Council. She quoted the General Plan; on page 147, " The White Tank Mountain Regional Park is a significant land form in the planning area a strong desire exists to protect and preserve the north and east areas outside of the park in their natural conditions."

SPEAKER: Ray Prendergast 10914 Palmeris Dr., wanted to call attention to the 2020 General Plan and voice his concern that the city guard Sun Valley Parkway and maintain the Parkway in it’s natural state.

SPEAKER: Bill Lipscomb, 14976 W. Bottletree, stated his concern to maintain the area around the White Tank Mountains as rural.

SPEAKER: Ed Mays 18499 W. Acoma Road, stated his concern with the small amount of animal agriculture. He also stated another concern is that the washes to the White Tank Mountains are shown on the map under Sun Valley Parkway, but not shown west of the Beardsley Canal and he feels like a second class citizen because of that. He stated he doesn’t get a warm and fuzzy feeling that we want him as part of the city when we exclude his community from planning efforts.

Commissioner Gonzales wanted to know of the 70 square miles of the city, how much is rural.

Assistant Planning Manager Chinyere replied that 9% of the city is designated as rural.

Commissioner Senft stated he felt the city was not thinking about the best use of the lands.

SPEAKER: Paul Gilbert 3200 N. Central, stated that he is representing property owners and he objects to the animal agriculture designation on those properties. He also stated that he has worked with Mr. Counts and that he is extremely professional.

SPEAKER: Sherry Baler, stated she is in favor of trail systems along the White tank Mountains.

Vice Chairman Bails closed the hearing to the public.

Commissioner Morris stated he would like all the washes to be shown on the map.

Commissioner Gonzales stated their needs to be an amount of horses designated per acre.

Commissioner Senft stated he would like 4 horses per acre designated.

Vice Chairman Bails and Commissioner Gonzales both disagree with 4 horses per acre, they stated they felt that number was too high.

D-2. Consideration and Action - Rural Development Standards and Design Guidelines status

The City of Surprise Planning and Zoning Department is requesting consideration and action on adopting the Rural Development Standards and Design Guidelines as an element of the General Plan 2020.

Vice Chairman Bails stated that they would vote on each recommendation separately.

Commissioner Morris made a motion to approve recommendation #3, attached hereto as Exhibit A. Commissioner Senft seconded the motion,

SPEAKER: Carolyn Robles 14041 N. 184th Ave., stated that at a meeting with Phil Testa and Tony Chinyere it was stated that the county allows 3 horses per acre and that had been agreed on.

Commissioner Gonzales stated that 3 horses per acre is good and then 1 additional horse per additional acre.

Commissioner Senft made a motion to approve recommendation #4, stating 3 horses per acre and an additional 2 horses per additional acre, attached hereto as Exhibit A. Vice Chairman Bails seconded the motion.

E-1. Public Hearing – Application PP01-27
Gary Claybaugh of Landmark Engineering Inc., on behalf of Boa Sorte, L.P., Viel Gluck, L.P. and Ben Fatto, L.P., property owner is requesting consideration and action on a Preliminary Plat Map of Dedication of roadways and easements for a residential subdivision, located between the Greenway Road alignment and Waddell Road, from the west side of Cotton Lane to the Beardsley Canal. (Sierra Montana - Map of Dedication)

Vice Chairman Bails wanted to know if the public wanted to speak tonight or wait until there is a full commission.

SPEAKER: Carolyn Robles 14041 N. 194th Avenue, stated that it’s hard for people to come to the meetings and there are several issues on this application. She would like this application to be tabled indefinitely.

Community Development Director Testa stated that it was up to the commissioners if they wanted to hear from the public tonight or wait until there is a full commission.

Deputy City Attorney Mariscal stated the status of the case against Sierra Montana has been appealed and the transcript is before the Supreme Court. The city and the commission have agreed to go forward with this application.

SPEAKER: Ed Mays 18499 W. Acoma Road, stated his concern with new commissioners getting the transcripts regarding Sierra Montana from past meetings.

Community Development Director Testa stated that the new commissioners will receive transcripts of past meetings and be briefed by staff. He stated that it is important thought for the new commissioners to hear it from the people also.

SPEAKER: Paul Gilbert 3200 N. Central Ave., stated that since the referendum was thrown out in court, the applicant has the right to process the plat and they are entitled by law to have the case heard.

E-2. Consideration and action on Application PP01-27
Gary Claybaugh of Landmark Engineering Inc., on behalf of Boa Sorte, L.P., Viel Gluck, L.P. and Ben Fatto, L.P., property owner is requesting consideration and action on a Preliminary Plat Map of Dedication of roadways and easements for a residential subdivision (Staff Recommendation - Approval)

Commissioner Morris made a motion to continue this application till the August 7, 2001 regularly scheduled meeting. Commissioner Gonzales seconded the motion.

Paul Matthews of GMI Southwest Inc., on behalf of Surprise America L.L.C., property owner is requesting consideration and action on a Final Plat Amendment for a commercial subdivision, located south of Grand Avenue and adjacent to the Mountain View Drive alignment. (Grand Avenue Professional Plaza)

Planner Penland made a presentation for Application FPA01-38, he added an additional stipulation.

Vice Chairman Bails opened the hearing to the public. There were no questions or comments from the public. Vice Chairman Bails closed the hearing to the public.

SPEAKER: Paul Matthews of GMI Southwest Inc., stated his concern with stipulation c.

Deputy City Attorney Mariscal stated that stipulation c is not needed because the Surprise Municipal Code allows the Planning and Zoning Commission to approve or deny Site Plan submittals based upon the prevision of adequate sewer capacity.

G-2. Consideration and action on Application FPA01-38
Paul Matthews of GMI Southwest Inc., on behalf of Surprise America L.L.C., property owner is requesting consideration and action on a Final Plat Amendment for a commercial subdivision. (Staff Recommendation – Approval)

Commissioner Morris made a motion to approve Application FPA01-38, subject to stipulations a – c attached hereto as Exhibit B. Commissioner Senft seconded the motion.

H-1. Public Hearing – Application FP01-33
Joseph T. Oddo of Citrus Heights Ranches, property owner is requesting consideration and action on a Final Plat for a residential subdivision, located at the northeast corner of Bullard Avenue and Waddell Road. (Royal Ranch Unit 1 Parcel 1)

Planner McGeough made a presentation for Application FP01-33 through Application FP01-37. He stated there were 4 separate plats and 1 Map of Dedication.

Commissioner Morris had concerns with setbacks and the total area between the sidewalk and houses.

SPEAKER: Joe Oddo of Citrus Heights Ranches, stated that those concerns have been handled in the PAD.

Planning Manager Phillips stated that the setbacks are from the visibility lines and are approved by the City Council. The streets in the subdivision are the standards streets throughout the city.

Commissioner Morris made a motion to approve Application FP01-37, subject to stipulations a – j attached hereto as Exhibit G. Commissioner Gonzales seconded the motion.

M-1. Public Hearing – Application CUP00-147
Gerald Kesler of Brake Masters, property owner is requesting consideration and action on a Conditional Use Permit for an automotive facility located at 13758 W. Bell Road. (Brake Masters)

Planner Penland made a presentation for Application CUP00-163.

Vice Chairman Bails had concerns with which direction the bay doors will be facing.

Planner Penland replied that the bays will be facing existing parking and additional planters will be used for screening.

Commissioner Gonzales had concerns with the wall that is being installed being too close to the existing wall. He also wanted to know the total amount of bay doors.

SPEAKER: Jerry Kesler of Brake Masters, stated that there is sixteen feet between Brake Masters and the shops, ten feet of which will be landscaped.

Commissioner Morris had concerns about the handicap parking.

SPEAKER: Jerry Kesler stated that they moved the handicap parking spaces closer to the building and added a sidewalk for better access for the public.

M-2. Consideration and action on Application CUP00-163
Gerald Kesler of Brake Masters, property owner is requesting consideration and action on a Conditional Use Permit for an automotive  facility. (Staff Recommendation – Approval)

 Commissioner Morris made a motion to approve Application CUP00-163, subject to stipulations a – l attached hereto as Exhibit H. Commissioner Gonzales seconded the motion.

N-1. Public Hearing - Application PADA00-101
Joe Walsh of Coe & Van Loo Consultants, Inc., on behalf of Dietz Crane Builders L.L.C., property owners is requesting approval of a Planned Area Development Amendment, consisting of rezoning 44 acres from High Density Residential to Single Family Residential. Subject property is located at the northeast corner of 115th Avenue and Avenue of the Arts. (Parcel 5 of Canyon Ridge West)

Planner McGeough made a presentation for Application PADA00-101. He stated that the applicant has redesigned their proposal since the last time they were in front of the commission.

Commissioner Senft had concerns with the buffering on the project.

SPEAKER: Joe Walsh replied the buffer is about 150 feet on the east of the property.

Commissioner Morris stated his concerns with the infrastructure.

Planner McGeough stated that with the previously approved Final Plat for commercial property it was stipulated that a street light be placed at the intersection of 115th Avenue and Union Hills Drive.

Commissioner Morris had concerns regarding the walls around the perimeter of the project being aesthetically pleasing. He also wanted to know if the applicant is widening 115th Avenue.

SPEAKER: Joe Walsh stated they could use a mix of homes and possibly pop outs along the walls. Additionally they could create a staggering affect instead of straight walls, still including landscape to help soften the walls.

Planner McGeough stated the applicant is required to do road improvements along 115th Avenue and Union Hills including landscaping.

Commissioner Morris wanted to know what was going to happen to the small street that connects Avenue of the Arts to 115th Avenue.

SPEAKER: Joe Walsh stated that street will be abandoned allowing the area to be used for future development.

Commissioner Gonzales had concerns regarding the power lines and if there have been any studies done about long term health affects from living under and by power lines.

SPEAKER: Joe Walsh replied that there are no studies to show that living under power lines causes any health problems. He stated that there is a 75-foot easement between the power lines and any of the homes.

N-2 – Consideration and action on Application PADA00-101
Joe Walsh of Coe & Van Loo Consultants, Inc., on behalf of Dietz Crane Builders L.L.C., property owners is requesting approval of a Planned Area Development Amendment, consisting of rezoning 44 acres from High Density Residential to Single Family Residential. (Staff Recommendation – Approval)

Commissioner Senft made a motion to approve Application PADA00-101, subject to stipulations a – h attached hereto as Exhibit I. Commissioner Bails seconded the motion.

Motion passed. 4 Yeas, O Nays, and 1 Absent

O-1. Consideration and action on Application – SP01-43
Greg Zimmerman of L.R. Niemiec Architects, Inc., on behalf of Mountain Vista Ranch L.L.C., property owner is requesting consideration and action on a Site Plan for an apartment complex, located at 16630 N. Reems Road. (The Villas Apartments) (Staff Recommendation – Approval)

Planner Penland made a presentation for Application SP01-43. He stated the applicant held a neighborhood meeting and the meeting went well.

Commissioner Senft wanted to know if the complex was gated.

Planner Penland replied the complex is gated.

Commissioner Morris wanted to know if there were at least 2 covered parking spaces per apartment.

Planner Penland stated there will be 1.15 covered stalls and 2.25 parking spaces per apartment.

SPEAKER: Greg Zimmerman stated that they have met the requirement for parking spaces. He stated that the surrounding neighborhoods wanted minimal covered parking spaces along the property lines.

Vice Chairman Bails had concerns regarding storage areas for each apartment and if the complex was going to have recycling bins so the residents can recycle.

SPEAKER: Greg Zimmerman replied that each apartment unit has ample storage area within the unit. There are 2 trash receptacles and one of them can be turned into a recycling receptacle.

Commissioner Morris had concerns with all the landscaped and activities areas are in the retention areas. He also stated concerns with the size of the balconies.

SPEAKER: Greg Zimmerman stated that there is a playground facility in the northwest corner of the complex that is a negative retention area. He stated that all balconies are at least approximately 100 square feet.

Commissioner Senft wanted to know if the residents of the complex were going to be notified of the overflights from Luke Air Force Base.

SPEAKER: Greg Zimmerman stated there will be notice of the overflights in the lease agreement.

Vice Chairman Bails made a motion to approve Application SP01-43, subject to stipulations a – o attached hereto as Exhibit J. Commissioner Senft seconded the motion.

VI. COMMENTS FROM THE FLOOR ON NON-AGENDA ITEMS:

There were no comments from the floor.

VII. REPORT FROM PLANNING AND ZONING DEPARTMENT:

There were no comments from the Planning and Zoning Department.

VIII. REPORT FROM PLANNING AND ZONING COMMISSION:

Commissioner Morris wanted to know if the two new Planning and Zoning commissioners will be in place for the next meeting.

Community Development Director Testa stated they should be in attendance for the next meeting. He also stated there are discussions about staggering the commissioners terms but nothing has been finalized.

IX. ADJOURNMENT:

There was no further business. On a motion duly made and seconded. Vice Chairman Bails declared the meeting adjourned at 11:40 P.M.
